The International Court of Justice considered that it was not competent to impose temporary measures in the lawsuit filed by Nicaragua against Germany on the grounds of facilitating the genocide against the Palestinians by supporting Israel with weapons, but the court rejected a German request to stop hearing the case, which means that it will move forward.

Meanwhile, the head of the Nicaraguan International Justice team said that the case against Germany regarding arms exports to Israel is still in its infancy and has a long path, and the scope is open to present all the facts.

The court explained that it remains deeply concerned about the situation in Gaza.

This came in the court’s decision announced by its president, Nawaf Salam, in the session held to rule on a lawsuit filed by Nicaragua against Germany, on charges of facilitating genocide in Gaza by supporting Israel with weapons and money in addition to diplomatic support.

Salam said in the sentencing session, which was broadcast live: “The court believes that it does not have the powers to impose temporary measures against Germany.”

He continued: "The court found that it has no jurisdiction to impose temporary measures regarding German arms exports to Israel."

On the other hand, Salam expressed “concern about the catastrophic humanitarian conditions that the people of Gaza are suffering from,” and called for respect for international laws that guarantee the protection of civilians.

On March 1, 2024, Nicaragua filed a case before the International Court of Justice demanding that Germany be obligated to stop its military support for Israel, which “facilitates the commission of genocide” against the people of Gaza.

Since October 7, Israel has been waging a devastating war on the Gaza Strip that has left tens of thousands of martyrs and wounded, most of them children and women, in addition to massive destruction and famine that has claimed the lives of children and the elderly, according to Palestinian and UN data.

Israel continues its war despite the issuance of an immediate ceasefire resolution by the Security Council, and despite its appearance before the International Court of Justice on charges of committing "genocide."
