The High Court in Podgorica has made a historic ruling, rejecting South Korea’s plea for extradition and ordering the extradition of Do Kwon, the former CEO of Terraform Labs, to the United States. The court’s decision is the result of lengthy discussions about the extradition’s political and legal ramifications.
Reports indicate that Do Kwon, co-founder of Terraform Labs, who has been detained in Montenegro since March 2023, would allegedly be sent to the US to face fraud accusations.
Principal Ally in Foreign Policy
A report from Montenegrin news site Pobjeda states the High Court of Podgorica denied a plea to extradite Kwon to South Korea before the United States. The fugitive was sought for by both South Korea and the U.S.
Nevertheless, according to the news source, Montenegro’s Justice Minister Andrej Milović dropped hints about the decision’s political underpinnings, highlighting the United States’ role as Montenegro’s principal ally in foreign policy and the urge to enhance legal mechanisms for potential extraditions between the two nations.
The verdict came only two weeks after the Montenegrin Appeals Court overturned the extradition ruling to South Korea. Do Kwon’s legal team filed an appeal, claiming the court had disregarded correct procedure and violated extradition requirements. But it seems it won’t matter anymore since Do Kwon is about to be extradited. The exact date of Kwon’s extradition to the U.S is still unknown.
His whereabouts were mostly unknown after Terra’s May 2022 collapse. Until Montenegrin officials detained Kwon in March 2023 for using fake travel credentials. He is now undergoing extradition procedures while serving a four-month jail term.
