Is US SEC Poised To Drop XRP Lawsuit By May?

As the US Securities and Exchange Commission (SEC) repeatedly acknowledges XRP ETFs, anticipations build for a potential conclusion to the Ripple Vs SEC case. Amidst the SEC’s endeavor to establish a crypto-friendly regulatory atmosphere in the country, experts foresee an imminent XRP lawsuit settlement. Adding credence to existing speculations, lawyer James Murphy predicts the Ripple case to conclude before May 2025.

Will XRP Lawsuit Settle Before May 2025?

Amidst mounting speculation about the XRP lawsuit settlement, James Murphy, also known as MetaLawMan, shared his thoughts. In an X post, MetaLawMan opined that the Ripple Vs SEC case could find a conclusion before April 16, 2025.

Notably, Ripple is expected to submit its appellate brief on April 16. The lawyer suggested that the XRP lawsuit could potentially settle before Ripple submits its appellate brief on April 16, 2025.

Further, commenting on the complexity of the case, MetaLawMan highlighted Judge Analisa Torres’ XRP judgment and the $125+ million penalty. The post read, “The Ripple situation is more complex than the Crypto Exchange cases, given the added complexity of the Torres judgment and the disposition of the escrow.”

XRP ETF and Ripple Lawsuit: What to Know?

Over the past few days, the crypto community has been abuzz with excitement as the SEC acknowledged XRP ETF applications submitted by multiple asset managers. These investment firms include Grayscale, CoinShares, 21Shares, Bitwise, and Canary Capital.

Though these acknowledgments do not guarantee an XRP ETF approval, they do add more color considering their impossibility under the previous leadership. Many believe that the XRP ETF could have only been a dream under former SEC Chair Gary Gensler. MetaLawMan stated, “Gary Gensler converted the SEC into a political weapon.”

Significantly, the ETF acknowledgments here are a notable sign of a departure from the previous administration’s skeptical stance. However, if the restructured SEC needs to restore credibility, resolving the XRP lawsuit is crucial, said MetaLawMan.

Meanwhile, legal expert Jeremy Hogan hopes the XRP lawsuit settlement is possible before May. He has also commented on the higher probability of the Ripple vs SEC case conclusion before the approval of an XRP ETF.

How Coinbase Case Settlement Impacts Ripple Lawsuit?

Notably, the recent settlement of the Coinabse lawsuit has boosted speculations of a positive development in the Ripple Vs SEC case. However, there is a “degree of uncertainty” surrounding the XRP lawsuit settlement as highlighted by Fox Business journalist Eleanor Terrett. To strengthen her point, Terrett highlighted the SEC’s words, “We are in uncharted territory right now.”

The uncertainty arises from the complexity of the XRP lawsuit compared to the Coinbase case. A key factor is the existing order from Judge Torres, requiring Ripple to pay a $125M penalty. As per the final judgment, Torres will maintain jurisdiction over the case until August 7, 2025, to ensure compliance.

This adds a layer of complexity to the case as the SEC needs to negotiate with the district court regarding the penalty ruling, potentially seeking a reduction or dismissal. In addition, the regulator needs to seek approval from Judge Torres as the presiding judge.
